SimpleTort may use and disclose PHI only as permitted or required by HIPAA and applicable law, including: to provide our platform services to covered entity clients (treatment, payment, and healthcare operations); as required by law, including court orders and subpoenas; for public health activities as required by law; to avert a serious threat to health or safety; and as otherwise permitted by the covered entity's authorization or HIPAA regulations.
SimpleTort enters into Business Associate Agreements (BAAs) with all covered entity clients before accessing, processing, or storing PHI. Our BAAs comply with 45 CFR 164.502(e) and 164.504(e) and address: permitted and required uses and disclosures of PHI; safeguards to prevent unauthorized use or disclosure; breach notification procedures and timelines; return or destruction of PHI upon contract termination; and subcontractor compliance requirements.
SimpleTort maintains administrative safeguards including: a designated HIPAA Privacy Officer and Security Officer; workforce training on HIPAA requirements (upon hire and annually); sanctions for workforce members who violate HIPAA policies; regular risk assessments and compliance audits; documented policies and procedures for PHI handling; and an incident response plan with documented breach notification procedures.
Our cloud infrastructure providers maintain physical safeguards including: facility access controls and visitor management; workstation and device security policies; media disposal and re-use procedures; and environmental controls (fire suppression, climate control, power redundancy).
SimpleTort implements technical safeguards including: AES-256 encryption for PHI at rest; TLS 1.3 encryption for PHI in transit; unique user identification and authentication; mandatory multi-factor authentication for all users; automatic session timeout and audit controls; access controls based on minimum necessary standard; and comprehensive audit logging of all PHI access and modifications.
In the event of a breach of unsecured PHI, SimpleTort will: notify the affected covered entity without unreasonable delay and no later than 60 days after discovery; provide all information required for the covered entity to fulfil its breach notification obligations; cooperate fully with the covered entity's breach investigation and response; and document the breach, investigation, and remediation in accordance with HIPAA requirements.
Individuals whose PHI is processed through the SimpleTort platform have rights under HIPAA, including the right to: access their PHI; request amendments to their PHI; receive an accounting of disclosures; request restrictions on certain uses and disclosures; and file a complaint with the U.S. Department of Health and Human Services. These rights are exercised through the applicable covered entity (our client). SimpleTort will cooperate with covered entities to fulfil individual rights requests.
SimpleTort operates on enterprise cloud infrastructure with a signed HIPAA Business Associate Agreement covering all PHI processing. Our cloud service providers maintain SOC 2 Type II certification, HIPAA compliance attestation, and independent third-party security audits.
